Terms of Use

1. GENERAL:

1.1 This agreement governs your use of the web magazine site of Textile Treasure published and operated by Media Vision and the related services (called, the SERVICE). Additional terms and conditions of use applicable to specific areas of the Service may also be posted in such areas and, together with this agreement govern your use of those areas. This agreement together with any such additional terms and conditions, are referred to as this AGREEMENT.

1.2 Media Vision reserves the right, in its discretion, to change or modify all or any part of this AGREEMENT at any time, effective immediately upon notice published on the SERVICE. Your continued use of the SERVICE constitutes your binding acceptance of these terms and conditions, including any changes or modifications made by Media Vision as permitted above. Please be sure to review this AGREEMENT periodically to ensure familiarity with the most current version. If at any time the terms and conditions of this AGREEMENT are no longer acceptable to you, you should immediately cease all use of the SERVICE.

2. SERVICE ONLY COMMUNICATES

2.1 The SERVICE acts as the internet-based platorm for users to know and understand the happenings, changes and various programmes including fashion trends/forcasts in terms of news, views and commentary and also for the users to locate prospective partners to trade with. Media Vision and its product Textile Treasure are in no way involved in the actual transaction between trading partners. In other words, none of the service providers i.e. Media Vision and Textile Treasure have any control over the quality, safety, delivery or legality of the items being traded through the platform. Hence, in the event of any dispute between the user and advertiser, Media Vision as well as Textile Treasure will be released from any claims, demands and damages of every kind and nature arising out of such disputes.

2.2 The users of the portal are currently provided with a variety of news, view and commentary under News Zone, Fairs/Exhibitions/Events, Import-Export Data Analysis, Fashion Trends/Forecasts tabs and with a variety of directories under Sourcin Zone tab to locate trading partners. All information under these tabs is derived from sources, which are considered to be reliable by Media Vision and Textile Treasure. The sources may be press releases/notes, notifications, websites/portals, newspapers, magazines, journals, bulletins, periodicals, etc., besides our in house research team’s analytical work on export/import data and interview-based articles. Hence, information gathered from different sources is passed on to the viewers of the web magazine TEXTILE TREASURE without any responsibility on the part of Media Vision and Textile Treasure. Similarly opinions/views expressed by third parties in abstract and/or in the interviews are not necessarily shared by Media Vision and Textile Treasure.

3. MEMBER SERVICES/SUBSCRIPTION/REGISTRATION

3.1 The contents on the web site of the magazine TEXTILE TREASURE are freely viewable. However, certain portions/areas are open to only members subscribing to such services on payment of prescribed subscription fee. In order to avail such services, you need to register yourself on line by providing details such as your name, email address, correspondence address, telephone number and facsimile number,etc., besides paying the requisite subscription fee.

3.2 By using the SERVICE and registering yourself as member, you represent and warrant that all registration information you submit is truthful and accurate and you agree to the accuracy of such information

4. ADVERTISEMENTS/PROMOTIONS

The web magazine TEXTILE TREASURE accepts advertisements of companies and their products. While accepting such advertisements, the intending advertisers are made to agree that the services and the items offered for trade:

Will not be fraudulent or involve the sale of counterfeit or stolen items;
Will not infringe any third party’s copyright, patent, trademark, trade secret or other proprietary rights of publicity or privacy;
Will not violate any law, statute, ordinance or regulation;
Will not be defamatory, trade libelous, unlawfully threatening or unlawfully harassing;
Will not be obscene or child pornography.

5. LINKS TO AND FROM THE PORTAL

The Services may provide, or third parties may provide, links to other World Wide Web sites or resources. Because we have no control over such sites and resources, you acknowledge and agree that we are not responsible for the availability of such external sites or resources, and do not endorse and are not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

6. DISCLAIMER OF WARRANTY

6.1 You expressly understand and agree that your use of the service is at your own risk. The service is provided on an "as is" , "as available" and "as on" basis. We expressly disclaim all warranties of any kind, whether express or implied, including without limitation, the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

6.2 We make no warranty that: (i) the services will meet your requirements; (ii) the services will be uninterrupted, timely, secure, or error-free; (iii) the results that may be obtained from the use of the services will be accurate or reliable; and (iv) the quality of any products, services, information or other material purchased or obtained by you through the services will meet your expectations.

6.3 Any material downloaded or otherwise obtained through the use of the services is done at your own discretion and risk and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material. No advice or information, whether oral or written, obtained by you from us or through or from the services shall create any warranty not expressly stated in these terms.

7. LIMITATION OF LIABILITY

You expressly understand and agree that we shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including without limiation, damages for loss of profits, goodwill, use, data or other intangible losses (even if we have been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the services; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchases or obtained or messages received or transactions entered into through or from the services; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the services; or (v) any other matter relating to the services.

8. PAYMENT TO AVAIL SERVICES

8.1 Once you, your company or your authorised agents chooses to avail any of the services provided by this site and pay the requisite charges by online credit card payment system, the service provider for which is Avenues (India) Pvt. Ltd., Plaza Asiad, 2 nd Floor, Station Road, Santacruz (West), Mumbai (India), it implies to you that your credit card account be deducted with an equivalent amount of Indian currency as applicable to be credited to Media Vision, the publishers of web magazine Textile Treasure, on the day of transaction.

8.2 Payments may also be made by way of pay order/demand draft favouring “Media Vision” payable at New Delhi ( India ).

8.3 Payments once made by credit card or otherwise are non-refundable.

No part may be reproduced in any form, without explicit written permission from TEXTILE VISION or MEDIA VISION. Materials provided in the web magazine pages may contain other copyright information and proprietary notices related to those particular materials.

9.2 Portions of the web magazine such as Import/Export Data Analysis and Sourcing Zone containing database may not be reproduced, copied, or transmitted in any form, for the purpose of inclusion in other databases, data sources, resources, collections, or compendiums without written prior consent.

9.3 As between you and TEXTILE TREASURE (including MEDIA VISION), we are the owner and/or authorised user of any trademark, and/or service mark appearing on the site, and are the copyright owner or licensee of the content and/or information on the site, unless otherwise indicated. Except as otherwise provided herein, use of the site does not grant to you a license to any content, features or materials you may access on the site. Any commercial use of the site is strictly prohibited, except as allowed herein or otherwise approved by us. You may not download or save a copy of any of the content or screens except as otherwise provided in these Terms and Conditions, for any purpose. You may, however, print one (1) copy of the information on the site solely for your personal use or records. If you make other use of the site, except as otherwise provided above, you may violate copyright and other laws and may be subject to liability for such unauthorised use.
